Cannabidiol In Idaho

CBD in Idaho

Various states worldwide are now allowing the best CBD products due to the recent 2018 Farm Bill. Some even have allowed the use of medical marijuana for those suffering epileptic conditions. Unfortunately, CBD Idaho still has stringent requirements regarding the types and purposes permitted.

The Gem State explicitly bans all products derived from marijuana. On the other hand, those that are made from hemp are allowed. The best CBD in Idaho must be made of only cannabidiol, containing absolutely no THC. This is because CBD brings no potentially adverse effects, unlike psychoactive THC.

Have You Ever Wondered what CBD IS?

Cannabidiol is a substance derived from hemp or marijuana, both cannabis plants. These plants have been used for millennia as herbal remedies, and cannabidiol is considered the possible source of its health benefits.

Scientists have been delving into the further study of cannabidiol. They have discovered that it’s a cannabinoid, a kind of substance naturally found in the human body. Moreover, they learned that it may help alleviate various medical conditions.

Consequently, people nowadays try to alleviate their chronic pains and other medical conditions with CBD products. This prompted several US states to adopt its legal consumption, especially due to the Farm Bill. After all, cannabidiol has been proven not to have the intoxicating psychoactive effects of tetrahydrocannabinol.

Still, CBD Idaho remains to be strictly regulated under state laws. The Gem State is wary of the potential negative effects of THC found in marijuana. Thus, marijuana under Idaho Code has been strictly banned, but CBD from hemp oil is exempted from such restrictions.

Are CBD and THC the Same Thing?

Although cannabidiol and tetrahydrocannabinol may have similarities, their effects on the human body are completely different. Essentially, both are made with the same chemical formula, but their chemicals are arranged differently from each other. This structure difference will bring about different effects in the body once ingested.

Both CBD and THC may also be found in the marijuana plant. Hence, they are frequently conflated as one. However, the similarities end there as THC is responsible for the commonly-known “high” people experience from marijuana.

Is CBD the Same as THC?

To keep Idaho residents from THC’s potentially harmful effects, CBD oil extracted from marijuana is illegal in the state. In contrast, CBD oil extracted from hemp plants is legal in Idaho, provided it has no THC content.

By itself, cannabidiol has no psychoactive properties, so products containing pure CBD are allowed under Idaho law. Full-spectrum hemp products are considered illegal in Idaho, but users may still purchase and consume broad-spectrum hemp and isolates without legal repercussions.

Idaho CBD Law

CBD Idaho laws are more restrictive than the federal law when it comes to CBD products, especially regarding marijuana. Specifically, Idaho Code §37-2705 stipulates that any oil extracted from cannabis plants must absolutely have no trace of THC.

In contrast, the Farm Bill allows a minuscule amount of 0.3% THC for CBD products. Moreover, the substance must not be considered to be “marijuana” by definitions laid out in Idaho Code §37-2701.

Idaho CBD Law

What’s more, CBD Idaho laws even regulate which parts of the cannabis plant products are made from.

Hemp-derived cannabidiol products may only be sourced from its mature stalks, stalk fibers, oils, or cake from its seeds. Other compounds, salts, derivatives, mixtures, manufacture, or preparation of the mature stalks are also allowed. Additionally, sterilized cannabis seeds that cannot germinate are also permitted.

On the other hand, the Farm Bill allows cannabinoids from any part of the hemp plant.

This agricultural legislation removed the designation of hemp as a Schedule I controlled substance. In response, the S1146a bill was passed to reform CBD Idaho laws in 2015. This promised to allow parents of those with epileptic conditions to legally obtain CBD oil from across state borders.

However, several state government entities such as the Idaho State Police opposed the bill due to various issues. These included proper lab testing and law enforcement required to safely allow CBD oil in Idaho. Moreover, they were concerned about verifying product purity, specifying proper doses, and avoiding adverse interactions.

After careful deliberation, Governor C.L. “Butch” Otter vetoed the bill and offered an alternative solution. He issued an Executive Order for an Expanded Access Program (EAP). This allowed epileptic children to use the legal CBD drug called Epidiolex. Eventually, Governor Brad Little passed another CBD Idaho law in the form of a 2019 Executive Order.

This allowed the transportation of CBD in Idaho and across state lines, in accordance with the 2018 Farm Bill. Nevertheless, this still forbade the production of hemp and any of its products and derivatives.

Where to Get CBD in Idaho

Due to strict restrictions on hemp in Idaho, the state currently has no brick-and-mortar establishments that sell CBD oil. This can be attributed to the strict limitations for all cannabis products in the Gem State. Despite such stringent requirements, Idaho residents may still buy Idaho CBD oil online from various sellers.

However, Gem State residents are advised to verify the quality of their selected CBD product before purchase. They should check the online retailer’s background, track record, and customer reviews to ensure safe CBD oil use.

Most importantly, they must ask for medical advice about CBD use beforehand. They must procure such products in compliance with state laws, following legal procedures stipulated therein.

Other alternative treatments and medications may be considered first before trying cannabidiol.

No CBD product sold over-the-counter is intended to diagnose, treat, cure, relieve, or prevent any disease. Moreover, the FDA has yet to approve any CBD wellness product.

You should consult with your doctor or another qualified healthcare professional before you start taking any dietary supplements or trying any hemp-infused product.
