Essentially, both are made with the same chemical formula, but their chemicals are arranged differently from each other. Both CBD and THC may also be found in the marijuana plant. Hence, they are frequently conflated as one. However, the similarities end there as THC is responsible for the commonly-known “high” people experience from marijuana.

Idaho CBD Law

In contrast, the Farm Bill allows a minuscule amount of 0.3% THC for CBD products. Moreover, the substance must not be considered to be “marijuana” by definitions laid out in Idaho Code §37-2701.

Hemp-derived cannabidiol products may only be sourced from its mature stalks, stalk fibers, oils, or cake from its seeds. Other compounds, salts, derivatives, mixtures, manufacture, or preparation of the mature stalks are also allowed. Additionally, sterilized cannabis seeds that cannot germinate are also permitted.
On the other hand, the Farm Bill allows cannabinoids from any part of the hemp plant.
This agricultural legislation removed the designation of hemp as a Schedule I controlled substance. In response, the S1146a bill was passed to reform CBD Idaho laws in 2015. This promised to allow parents of those with epileptic conditions to legally obtain CBD oil from across state borders.
However, several state government entities such as the Idaho State Police opposed the bill due to various issues. These included proper lab testing and law enforcement required to safely allow CBD oil in Idaho. Moreover, they were concerned about verifying product purity, specifying proper doses, and avoiding adverse interactions.
After careful deliberation, Governor C.L. “Butch” Otter vetoed the bill and offered an alternative solution. He issued an Executive Order for an Expanded Access Program (EAP). This allowed epileptic children to use the legal CBD drug called Epidiolex. Eventually, Governor Brad Little passed another CBD Idaho law in the form of a 2019 Executive Order.
This allowed the transportation of CBD in Idaho and across state lines, in accordance with the 2018 Farm Bill. Nevertheless, this still forbade the production of hemp and any of its products and derivatives.

Due to strict restrictions on hemp in Idaho, the state currently has no brick-and-mortar establishments that sell CBD oil.
