However, the WSDA is working on getting these CBD products removed from the shelves of grocery stores.

Food and beverages that contain full-spectrum CBD oil in Washington state are illegal, but other hemp-derived products are permitted to be added to food. Permitted products include hulled hemp seeds, hemp seed protein powder, and hemp seed oil.

Of course, these other ingredients, including other cannabinoids, must comply with all other requirements.

Yes, hemp products like CBD oil in Washington state are legal. Cannabis consumers, particularly CBD-infused hemp oils, may possess marijuana in various shapes and forms. The CBD legal limits include possession of up to one ounce of marijuana, 16 ounces of marijuana-infused edibles in solid form, and 72 ounces of marijuana-derived CBD liquid.

If you are looking to grow, process, or market hemp for CBD, you first need to acquire a license through the Industrial Hemp Research Pilot program (IHRP). The program has simplified the process for interested parties by consolidating multiple application forms into just a single application.

This has drastically reduced processing times by minimizing the supporting documentation you need to present to secure a license. The 2018 Farm Bill made further changes to state laws, with the most notable being:

  • Growers are solely responsible for procuring the hemp seed cultivation they need. They must also notify the IHRP of the origins of the seed.
  • There is no longer a need to have a four-mile buffer distance from licensed marijuana growers.
  • License requirements have been streamlined to reflect new requirements.

Growers already licensed under the IHRP may simply transfer when the new hemp program comes into full effect. Regarding THC levels, Washington state CBD oil or industrial hemp must test less than 0.3% THC.

Take note that any CBD harvest that tests over 0.3% will no longer meet the law’s definition of industrial hemp. Currently, the IHRP has not prescribed the appropriate enforcement action for violations and is still deliberating it.

Marijuana and CBD are legal in Washington state, but there are still restrictions on purchasing these products. For instance, only adults 21 years old and above can purchase and process marijuana and CBD.

How much is CBD oil in WA?

CBD oil is a new product that is still finding its place in legality and price point. Like anywhere else in the country, the price range of trusted CBD oil can be so broad that it would be difficult to pin it on just one price point.

There is also the issue of what form and concentration of CBD you are buying that complicate average pricing further.

That being said, CBD oil grown locally and organically from licensed growers and comes with an accompanying certificate of analysis does not come cheap. These high-quality CBD products guarantee the purity and potency of their contents and can demand prices of at least $50 to $60 per 1,000-milligram bottle.

When converted, this comes out to about 5 cents per milligram.

But even this estimate is on the low side. Five cents is considered cheap when most of the competition’s best CBD products cost between 10 to 15 cents per milligram. Currently, prices cap at 20 cents per milligram, and this amount is rarely exceeded.
